世界贸易组织审查标准制度源流考——以乌拉圭回合谈判为主要线索

摘　　要：在乌拉圭回合谈判的初期,审查标准问题并未受到关注。在谈判后期,审查标准事项获得史无前例的关注,并被谈判代表列入了少数几个可能使整个谈判破裂的"交易杀手"名单当中。美国主张将其国内行政法上的"雪佛莱原则"引入到WTO的争端解决机制当中。最终妥协的结果是美国提案当中使用的"合理的"一词被替换成"可允许"一词,而且仅仅写入了《反倾销协议》第17.6条。其他领域的审查标准并没有结论,仅以部长决定的方式,指出3年后应当审议是否将第17.6条规定的审查标准适用到其他协议当中。At the very beginning of Uruguay Round,the issue of standard of review was not at the forefront of the negotiations.At the end of the negotiations,the issue of standard of review gained unprecedented significance and nearly became a＇deal-breaker＇.U.S.A argued that U.S Chevron doctrine provided a useful model for appropriate judicial restraint under the WTO dispute settlement mechanism.The term＇reasonable＇,which was prominently used in U.S.proposals,was replaced by the word＇permissible＇in Article 17.6of the AD Agreement.The standard of review in Article 17.6of the AD Agreement shall be reviewed after a period of three years with a view to considering the question of whether it is capable of general application.
