浙江省循环经济发展的法制保障体系探析

摘　　要：浙江省的循环经济立法日趋成熟,执法成效显著,司法注重创新。但也存在一些不足:立法还有空白有待弥补、内容有交叉冲突之处、可操作性略有不足;执法管理体制、考核机制和公众监督参与等有待加强;司法存在起诉难、取证难、执行难等问题。为促进浙江省循环经济的健康发展,必须建立健全循环经济立法体系,多措施完善循环经济执法效率,全方位加强循环经济司法保障。Currently, the legislative system of Zhejiangs the law enforcement system has produced marked effect, However, the legal guarantee system of Zhejiang＇ s circular circular economy is on the way of being matured, and the judicial system emphasizes innovation. economy still has some shortcomings. There are quite a lot of blank areas of legislation which need to be solved, overlapped and conflicting contents, and a lack of operability~ the law enforcement management system, assessment mechanism and public supervision and par- ticipation need to be strengthened~ and the judicial system has difficulties in prosecution, obtaining evidence, execution, etc. In order to promote the healthy development of Zhejiang＇s circular economy, we must establish a sound system of circular economy legislation, improve the efficiency of circular economy law enforcement through a multitude of measures, and comprehensively strengthen the judicial protection for the circular econo- my.
