摘 要:现有支持和倡导公共服务合同外包的学说构建了一个看似能够自圆其说的理论体系,实际上相关理论未臻完善,合同外包在人性假设、伦理价值、政府角色、法律适用方面蕴含着难以弥合的冲突;而在实践中,合同外包亦难以摆脱精明买家、道德风险、合同管理能力、政府空心化的严峻挑战。政府对此必须有一个理性和健康的认识。The existing theory supporting and advocating public service contracting out sets up a theoretical sys- tem which seems to be made out a good case, but actually the theory is not perfect. The theory of contracting out contains several conflicts difficult to bridge including hypothesis of human nature, ethics value, role of gov- ernment and application of law contains, which increase the uncertainty of the reform. What is more, in prac- tice contracting out has difficulty in getting rid of severe challenges such as smart buyer, moral hazard, contract management capabilities, and hollow government, so the government should keep rational and healthy awareness of these in order to avoid the attitude of praise highly or opposed without reason.
