摘 要:与西方发达国家相比,中国政府的跨部门协同从本质上来说是高度依赖纵向权威的"人治"协同,跨部门协同机制的法治化要素缺失。当前,我国依靠领导权威协同的模式不仅面临着公平公正缺失、协同不稳定等风险,而且从长期来看制约着我国的协同机制向制度化、规范化方向发展。探索中国政府的跨部门协同法治化路径需要借鉴西方发达国家的经验,以法律法规的形式明确部门职责权限,以精细化的思路进行制度设计,建立整体性的法律制度协调机制。Compared with western countries, the cross - agency collaboration of Chinese Government is highly dependent on the longitudinal authority with the main characteristics as collaboration by "rule of men" rather than rule of law. Such kind of collaboration model is vulnerable, which not only faces to lack of fairness and stability but also restricts the collaboration mechanism to develop in the direction of institutionalization and normalization. To explore the Chinese Government cross - agency collaboration under the rule of law needs to learn from the devel- oped countries in the west. Possible specific measures include clear up the department's responsibility jurisdiction in the form of law, carry out the exploration and practice of refined management and establish the legal system of collaboration mechanism in a holistic way.
