摘 要:按照私法自治原则和市场经济运行规律,法律严格限制我国集体建设用地使用权的流转就不再具有正当性。为此,必须修改和完善相关的法律法规,取消对农村集体建设用地使用权入市的法律限制,承认集体土地流转的合法性。一方面,授权国务院尽快制定《农村土地使用权流转条例》,将试点地区的实践经验上升为行政法规,使其与未来修订的我国《土地管理法》和《物权法》相互协调配合;另一方面,针对现行农村集体建设用地使用权流转制度存在的诸多问题,倡导建立科学的土地征收制度,创设合理的流转收益分配机制,确立农村集体建设用地使用权流转备案审查程序,构建农村产权流转交易市场,大力完善农村集体建设用地流转体系。According to the principle of autonomy of private law and the running rule of market economy,laws which limit people to transferring the right to use rural collective construction land no longer have legitimacy.Therefore,we must modify the laws and regulations,cancel the legal restrictions when the rights of rural collective construction land are traded,and admit the legality of transferring.On the one hand,we should authorize government to immediately formulate "regulation about transferring the right to use rural collective land",making the practice experience of pilot areas up to the administrative rules,keeping it coordination with the future revision of the " land management law" and " property law";on the other hand,aiming at the problems of current transferring system of rural collective construction land,we advocate to establish a scientific system of land expropriation,establish the reasonable income distribution mechanism,create the vetting process for transferring of rural collective construction land,construct the market for the transferring of rural property,and vigorously perfect the transferring system of rural collective construction land.
