摘　　要：选取了影响专利诉讼的三类因素:专利组合的数量规模、用于诉讼的专利质量、专利引用的片断化,建立了专利诉讼与三类因素的模型方程。通过对科技产业中专利诉讼样本数据的对比实证分析,得出结论:专利诉讼的发生概率与专利组合规模接近程度、专利质量高低具有相关性,与专利引用片断化程度没有相关性。In this paper , we choose three key influence factor in patent litigation： the scale of patent portfolio,the quality of the patent and the fragmentation of patent citations. Then we establish model equation between patent fitigation and three categories factors. Comparative empirical analysis was adopted to analyze sample data of patent ligigation of in technology industry. Some conclutions show that probability of occurrence correlates with patent portfolio litigation , high-low their scale and quality. However this probability of ocurrence has nothing to do with fragmentation of patent citations.
