论农地流转后用途异化倾向的法律完善

摘　　要：我国现有的农地管理法律制度存在农地社会功能弱化、相关权利主体农地收益分配失衡等滞后现象,在一定程度上助长了农地流转后用途的异化现象。建议制定《中华人民共和国农地用途管理办法》,在农地用途限制的原因与原则、农地用途维护义务主体、责任与监管制度等方面作出规范,并修订相关配套法律、法规,由此形成系统、协调的农地保障法律体系,更好地为农业现代化、城镇化建设服务。The circulation of rural land,rural land contracting right of management circulation,is the important measures that the transformation of the mode of land use,the promotion of agricultural modernization,the impelling the urbanization construction,and the solution the ＂three rural issues＂ in our country.However, ＂non-food＂ and ＂non-agricultural＂ tendency appeared in agricultural land use in farmland rapid transfer process,with varying degrees of negative impact aspects,such as food security.The existence of hysteresis in agricultural land management laws,such as,weakening of the social function of agricultural land,imbalance in the distribution of agricultural land revenue among the rights body,to some extent,contributed to the circulation of agricultural land alienation after use.Recommended formation ＂People’s Republic of China agricultural land use management approach＂ to regulation the restrictions and the principles of agricultural land use,The main legal obligations of safeguarding the agricultural land for agricultural,and liability and regulatory system,and revise related laws and regulations,based on these,forming a system,coordination of the legal system about agricultural land to protect,to better serve the agricultural modernization,and urbanization construction as well.
