摘　　要：公共行政学术史中,因研究取向与关注点的不同,学者们就公共行政合法性的概念界定、研究意义、来源等问题有着不同观点。经验主义与规范主义研究者分别从经验事实与价值规范的角度对公共行政合法性进行概念界定。21世纪以来,经验主义与规范主义兼重的概念界定方法日见其多。在公共行政合法性研究的现实意义问题上,学界曾有"死了"与"活着"两种观点,近来,公共行政合法性研究仍具现实意义的观点成为主流。不同研究取向的学者对公共行政合法性的主要来源的分析可归结为法律、宪法的逻辑与原则及公共、公平、公民等价值规范三个方面。由于公共行政合法性危机的分析与出路的找寻都必须着眼于现实、以规范为指导,经验主义与规范主义取向的学者们在这两个问题上虽各有侧重,但共识多于分歧。国内学者直至21世纪初才开始关注公共行政合法性问题,研究虽起步不久,但已取得初步进展。未来研究应避免前期理论中存在的一些误区,把握好合法性研究中几对关系的平衡,才能使理论不断趋于完善与深入。In the academic history of Public Administration,different arguments on the definition,the realistic significance and the resources of public administration legitimacy can be derived from different research orientations and concerns. Researchers with an empirical orientation focus on facts and experiences to define the legitimacy of public administration, while normativists focus on value norms. A methodology which reconciled two research orientations has gained popularity since the turn of the new century. ' Dead' or ' Alive' shows the two sharply opposing views on the significance of the issue,and 'Alive'has become the mainstream in recent years. Legislation,the logic of the Constitution and the value of Public,Fairness and Civilization are the three main resources of the legitimacy of public administration. More consensus than difference exists on issues of crisis and outlets of legitimacy,however,for researchers of both orientations focused on the reality and guided by value norms. Although getting to the issue only in recent years,the research work of Chinese scholars has covered the major aspects of these issues. To advance and deepen the theory,future researchers should avoid some pitfalls and search for the balance point between tensions of special perspectives.
