知情权视阈下的权力制约与监督研究

摘　　要：权力是一把双刃剑,要真正做到"权为民所用",就必须加强对权力运行的制约与监督。"以权利制约权力"是对公权力更基层、更普遍的制衡。信息公开、公民知情,既是民主政治的必要条件,也是公民制约与监督权力的重要前提。在我国,"以权利制约权力"模式面临的挑战与机遇并存,以知情权为例,挑战有:我国公民的知情权意识起步晚、诉求低,公民知情权的保障有待完善;机遇有:国内外对知情权的重视与保护,新媒体提供的新平台,意见领袖的异军突起等。Power is a double-edged sword. The practice of ＂power serving people＂ requires restrict and supervision over power operation. The practice of ＂ restricting power with power＂ is more basic and popular check and balance to the public power. Information disclosure and citizen＇ s right to know is both the requirement of democratic politics and the important premise of citizen＇ s right of restriction and supervision. In China, the model of ＂restricting power with power＂ faces both challenges and opportunities. Taking ＂the right to know＂ as example,the challenge includes in China people＇ s awareness of right to know starts late and hence is still at a low level;in other words, this right needs to be improved; comparatively, the opportunities are that this right is valued and protected overseas and the new media provides new platforms.
