摘　　要：专利分案申请是专利审批授权制度的一个重要内容。随着我国专利申请量的迅速增长,专利分案申请制度实施中存在的一些问题备受关注。梳理国际和我国有关专利分案申请的规定,借鉴欧美及日本等国的相关制度,分析我国专利分案申请制度存在的问题,在此基础上,提出完善意见,对提高专利质量,强化专利制度的确定性和有效性具有重要意义。The patent divisional application is one of important contents in the patent approval and authorized system. With the rapid increase in the number of patent applications in China, issues in the implementation of patent divisional application have been gradually concerned. Provisions to both International and China＇s patent divisional application should be combed, European, American, Japanese and other countries＇ related system should be used for reference, and issues in China＇s patent divisional application system should be analyzed. On the basis of what mentioned above, this article intends to provide suggestions about the perfection, which should have significance for improving patent quality as well as strengthening the determinacy and effectiveness of patent system.
