摘 要:可再生能源发展是应对气候变化的关键领域之一,在全球气候变化的背景下,各国、各地区的可再生能源发展战略目标,经历了从能源供给安全到能源环境安全的能源安全观的演进。我国作为最大的发展中国家,面临着减少和控制温室气体的巨大国内、国际压力。《可再生能源法》是我国可再生能源发展的基本法律依据,它规定了我国可再生能源发展的总体目标、基本政策和法律框架,以及一些具体的政策扶持、激励措施和法律保障制度。在将该法的法律功能定位于政府主导下的可再生能源产业促进的基础上,以《可再生能源法》为中心,对我国可再生能源立法进行了分析和检视,提出了完善《可再生能源法》立法,制定和完善相关配套性法律与政策,制定和完善分类立法与政策,制定地方立法,建立可再生能源技术标准和检测、认证体系等具体的政策与法律对策和建议。Renewable energy development is one of the key areas to address climate change under the back- ground of global climate change. For many countries and regions, renewable energy development strategic targets have experienced the evolution from the energy supply security to environmental security of energy exploitation and u- tilization. As the largest developing country, China is under the huge pressure to reduce and control of greenhouse gases in the both domestic and international context. Renewable Energy Law is the basic law of renewable energy de- velopment in China, which provides the overall goal of renewable energy development, the basic policy and legal framework, as well as some specific supportive policy measures and legal institutions. Based on the judgment that the legal function of Renewable Energy Law is to promote renewable energy industry development by means of the leading role played by the government, the renewable energy legislation is analyzed and reviewed. To improve the legislation and its legal effects, such specific suggestions as amending Renewable Energy Law, forming a complete set of law and policy, formulating classified legislation and policy, promoting local legislation, and establishing technical standards and testing systems renewable energy, are put forward.
