依法治国背景下的中国体育法治——基于十八届四中全会《决定》的法学思考

摘　　要：党的十八届四中全会全面开启我国依法治国的新征程。体育法治也随之成为体育治理的基本方式,更是实现中国体育治理现代化的基石。建设体育强国,实现体育治理现代化需要全面提升我国体育法治建设水平。通过对党的十八届四中全会《决定》的法学思考,在依法治国背景下,分析了中国体育法治新的图景,认为"依宪治体"应成为中国体育法治的最高准则,公民体育权利的确认与保障是中国体育法治的基本要旨,依法行政是中国体育法治的关键环节,体育产业市场治理的法治化是中国体育产业发展的根本保障,体育纠纷解决的法治化是中国体育法治建设水平的重要体现。中国体育法治还需与国际体育法治接轨,提升中国体育法治的国际话语权。通过中国体育法治的建设,实现中国体育的"良法善治"。The fourth plenary session of the eighteenth conference of the Communist Party of China has comprehen- sively initiated a new jottmey of country governance in China. Accordingly, sport governance by law becomes the basic way of sport governance, also the foundation stone for realizing the modernization of Chinese sport governance. The level of construction of sport governance in China needs to be comprehensively raised in order to build a powerful country of sports and realize the modernization of sport governance. Based on his legal contemplation about the Deci- sion made by the fourth plenary session of the eighteenth conference of the Communist Party of China, the author ana- lyzed the new prospect of Chinese sport governance, and put forward the following opinions： ＂sport governance by constitution＂ should become the highest rule for Chinese sport governance; the confirmation and assurance of citizen sport rights is the basic idea of Chinese sport governance; administration by law is the key link in Chinese sport gov- ernance; the legalization of sports industrial market governance is the basic assurance for the development of the Chi- nese sports industry, the legalization of sports dispute resolution is the important embodiment of the level of construc- tion of Chinese sport governance. Chinese sport governance also needs to get on the track of international sport gov- ernance, and to reinforce its internal speech right. The good governance of Chinese sports by good law will be realized via the construction of Chinese sport governance.
