依法治国背景下民族立法存在的问题及完善

摘　　要：以依法治国为基点,结合当前民族自治地方经济社会发展的新形势,指出民族立法存在着:对民族立法的重要性认识不到位;民族法律法规体系庞杂、混乱和冲突;立法没有针对性;立法程序和体系不完备及立法人员素质不高等问题。提出了新时期完善民族立法的建议:完善宪法对民族区域自治法的监督功能;动员全社会重视民族立法工作;认真落实民族区域自治法;加大民族规范性法律文件的规范化和系统化建设;紧密结合本民族、本地域的特点完善立法程序和提高立法人才队伍建设等改进路径。From the new situation of local economic and social development in autonomous regions, this paper is based on the view of ruling our country by law and has pointed out the problems in the national legislation： inadequate understanding of significance of national legislation, hugeness, chaos and contradiction of rule system of national legislation, lack of perti- nence of legislation, imperfection of legislative procedure and system, and low quality of legislators. Accordingly, the author of this paper has made some proposals to perfect the national legislation in new period： to perfect the constitutional supervision on autonomous laws of nationality regions, motivate the whole society to value the national legislation, put the autonomous laws in force, promote the standardized and systematic construction of legal documents in such regions, perfect the legislative proce- dure according to unique features of certain nationalities and regions, and strengthen the construction legislative staff.
