摘  要:内部规范与外部规范的总和构成了公务员规则之治的载体。但研究者往往聚焦于行政"外部规范",而轻视"内部规范"。由于公务员执法行为在官民和谐中的重要地位,以及内部规范的形式更加贴近于公务员实际工作,使得行为规范成了当代行政法治环境下行政机关改善公务员执法状况的重要手段。其功能主要体现为迈向规则治理、提高政府质量和注入行政价值观等;而在制度建构上,尽管晚近行为规范的数量和质量都呈现出较高的增长态势,但在规范内容、立法质量和实施效力等方面仍待进一步完善。对公务员的个人利益进行约束,或者引导其服务于公共利益,是行为规范设置的核心原则之一。The regulation of civil servants consists of internal and external code, but the internal code is often ignored in research. Because ofthe importance of civil servants' legal enforcement for the relation between government and civilians, and the proximity between the internalcode and the actual work of civil servants, code of conduct becomes an important means for the administration to improve civil servants' enforcement. It can promote the government of the rule, the quality of administration, and the administrative values; in system construction,although there is obvious increase in the quantity and quality of the conduct code, it needs further improvement in terms of the content of thecode, the quality of the legislation and the implement effect. To regulate civil servants' personal interests, or to encourage their service for thepublic interest is one of the key principles for the establishment of the conduct code.
