摘 要:政府职权"下沉"是当今我国行政体制改革的重要课题。在实践中,这一课题面临着"如何放得下"、"能否接得住"和"是否转得动"三大困境。造成这些困境的原因在于权力观念及其衍生的利益问题、基层政权建设滞后及其衍生的能力匮乏、制度供应不足及其衍生的合法性诘难。这些"问题"显然都与"体制"密切相关,其治本之策在于出台《地方改革法》,赋予地方改革的自主权,并在此基础上,由各地方政府自行出台相关改革法律文件和总体纲要,以统筹、协调改革的发展进程。Government authority "sink" is an important component of the current China's administrative system reform. In practice, the subject is faced with three big trouble of "how to put down", "will to live" and "whether to turn up" because of the concept of power and the conflict of interest it causes, or the backward of grassroots regime and the lack of ability it causes, or the shortage of system and the suspect of legality it causes. The fundamental ways to solve these problems is to formulate Local reform law. This law will give the local governments autonomy of reform. Then, these local governments can formulate the detailed rules for the implementation and the program of reform which will guide and coordinate the development of the reform.
