摘　　要：近年来,中国经济持续快速增长,现已成为世界上主要的资本输出国和资本输入国。为适应经济上的新变化,中国涉外投资法制也需要随之进行变革。目前其新格局已基本显现,主要表现在中国涉外投资法制新格局顶层设计雏形出现,中国外国投资法制修订和整合基本确定,中国境外投资法制进一步完善,中国对外缔结投资条约进入新阶段。可以确定,中国涉外投资法制三足鼎立的局面已初步形成。In recent years, China’s economy increases quickly, and China becomes the important capital exporting country and capital importing country all over the world. In order to suit for the new development, China’s international investment law needs to reform. Nowadays the new pattern of China’s international investment law appears. It is shown in these aspects as follows：firstly the embryonic form of top-level design appears;secondly, China’s foreign investment law is revising and integrating;thirdly, China’s overseas investment law is modifying;and lastly China’s conclusion of international investment treaty enters into a new stage. In a word, a situation of tripartite confrontation of China’s international investment law has taken shape.
