摘　　要：信息网络传播权,是在网络技术与数字化技术迅速发展的背景下,为更好地保护著作权人的利益而产生的著作权方面的拓展性权利。该权利的设置,在全面保护著作权人利益、鼓励创作等方面发挥了积极作用,同时也产生了许多不利影响,特别是对著作权人作品的过度保护不利于作品的流通,进而损害了社会公共利益。从某种意义上说,任何权利设置的最终目的都并非单纯保护某一群体的利益,而是实现利益分配的平衡。信息网络传播权制度的设计应统筹考虑著作权人、网络发展、社会利益等多方因素,具体措施包括对权利的客体作准确具体的分类,设计全方位、多层次的权利限制制度以及建立保护著作权的集体管理制度。The transmission fight of information network is the development of copyright protection in the con- text of the rapid development of network technology and digital technology. The establishment of such right played a great role in the comprehensive protection of copyright interests and inspiration of creation, but at the same time, it also produced many adverse effects, especially the over-protection of copyright works is not conducive to the circu- lation, and is actually to the detriment of the social and public interests. The ultimate aim of the set-up of any right is not to protect the interests of a certain group, but to realize the balance of interests. The design of the right of communication through information network system should take into consideration the copyright owner, network de- velopment, social benefits and other factors, the specific measures include the object of rights for accurate classifi- cation, design of omni-directional and multi-level system of restrictions on the rights and the collective management system of the establishment of the copyright protection.
