论西藏藏族婚姻形态习惯与国家法的会通

摘　　要：西藏藏族的婚姻具有其自己的形态习惯,这种婚姻形态习惯的产生有着深刻的地理、伦理、经济等原因,其兼具特殊性与合理性。尊重并实施宪法关于保护少数民族风俗习惯权利的规定,加强对民族地区婚姻形态习惯的调查、研究和评估,考量少数民族深层文化对其婚姻习惯生成的影响,通过判例指导制度对某些婚姻习惯予以确认,并对其规则予以合理维系,是促进西藏藏族婚姻形态习惯与国家法会通的有效途径,也是促进族际和谐有序及良性互动的重要方面。Tibetan marriage has its own special and rational customary forms resulting from geographic,ethic and economic reasons. The effective way to promote the integration of Tibetan marriage customs with the national law is to respect and carry out the provisions of the Constitution on the protection of the rights of minority customs,enhance investigation,study and assessment of marriage customs in ethnic regions,examine the influence of minority culture on the formation of their marriage customs, help institutions to give confirmation to some marriage customs through case examples,and maintain them in a reasonable way. This is also an important way to promote a harmonious,orderly and benign interaction among ethnic groups.
