城管行政执法中的法律问题及其对策研究

摘　　要：关于城管行政执法,需要对执法过程、执法相对人的救济以及对执法者的责任追究制度等涉及的法律问题进行研究,并探讨城管执法的对策和方法。通过对与城管执法中的行政管理与执法过程分离问题,抽象行政行为的审查机制缺失问题以及城管执法中的责任追究制度等进行分析和探讨,得出关于城管执法问题的解决,不仅仅涉及城管部门本身,围绕其存在的相关抽象行为审查机制以及行政行为的约束机制问题的研究亦至关重要。When we study the executive law enforcement of city management,it is necessary to discuss the related le-gal problems such as executive process,legal relief of the counterparts of administrative enforcement and system of ac-countability of the law-executors as well as the relating resolutions. Based on the problem of separating administrative management and the law enforcement process,deficiency of the review mechanism of abstract administrative act,and accountability system,the solution about the urban management law enforcement can be obtained,which is not only re-lated to the city management section,it also vital to study the review mechanism of abstract administrative act and the restriction mechanism of administrative act.
