摘　　要：《刑法修正案(九)》对死刑规定修改呈现出以下几个特点:在废除死刑的罪名中,暴力犯罪与非暴力犯罪并存,以非暴力犯罪为主;废除的死刑罪名多数是备而不用的,废除死刑的宣示意义大于实际意义;限制死刑与废除死刑并举;总则与分则同时修改的模式。但依然存在对联合国公约的回应不够、存有进一步废除死刑罪名的空间、对死缓制度的修改不够彻底等问题。未来修法需要修改死刑适用的条件,大幅度废除非暴力犯罪的死刑,在废除非暴力犯罪死刑的同时同步废除暴力犯罪的死刑,完善死缓制度,在司法实践中转变重刑观念并控制死刑的实际适用。The characteristics of the provisions concerning modifying death penalty in Amendment IX to Criminal Law are as follows： during the crimes whose death penalties are abolished, violent crimes and non - violent ones coexist, and the latter are dominant; most of the abolished death penalty charges are on the shelf, so the declared significance of abolishing the death penalties outweighs the real one; the restriction and abolition of death penalties are carried out simultaneously; the mode of revising the provisions of death penalties is the combination of the general provisions and the specific provisions. The problems existing in the provisions concerning modifying death penalty are as follows： the response to the United Nations Convention is not enough; there is room for the further abolition of death penalty charges ; the modification concerning the system of death sentence with a reprieve is not thorough. Therefore, in the future, the conditions for applying death penalty should be modified, the death penalties of non - violent crime be abolished drastically, the abolition of the death penalties of non violent crimes and violent ones be simultaneous, the system of death sentence with a reprieve be improved, and the concept of severe punishment be transformed, and the application of death penalty be controlled.
