社会管理创新视角下交通违法处罚的重构

摘　　要：当前道路交通违法处罚制度存在着重处罚轻教育的倾向,部分处罚措施缺乏针对性导致效果有限,对于多次同种违法行为仍然采用同一处罚标准未能体现量罚原则。警告处罚未能起到警示作用流于形式,吊销制度在取消驾驶权利的同时也消灭了当事人的驾驶能力,注销驾驶证制度存在过度适用且缺乏行政救济途径的不合理之处。解决的措施是以交通安全义工制度强化对违法当事人的教育;对累犯实行递进加重处罚体现量罚原则;实行驾驶技能资格证与驾驶许可证制度,用驾驶许可证停牌制度取代暂扣和吊销制度;部分处罚可用替代方式执行。The current traffic offense penalty system tends to focus more on penalty rather than education. Part of the punitive measures lack specificity which leads to limited effect. For repeated offense of the same kind, using the same punishment standard will not reflect the principle of punishing according to the times of violations. Warning penalties are unable to play a warning role, which seems like a mere formality. The revocation system ex- ploits the driving fights of the parties on one hand, also it eliminates the driving ability as well. The revocation sys- tem of driver~ license is unreasonable because it is sometimes over - used and lacks administrative remedies path- way. Measures to address these problems are to strengthen the education for illegal parties based on traffic safety volunteers system. For the recidivist, we shall implement progressive aggravating punishment by following the prin- ciple of punishing according to the times of violations, implement driving skills certificate and driver~ license sys- tem and replace the temporary suspension and revocation system by using driving license suspension system. Part of the implementation of punishment can be executed by other means.
