摘  要:在处理因墨西哥湾漏油事故所引起的纠纷及诉讼过程中,BP公司采取了一系列相对有效的风险管控措施:一是事发后全力止损散损;二是在可接受的限度内,优先以和解方式处理索赔;三是在民事和刑事(包括公共集团)诉讼并发时,先应对刑事和集团诉讼,后处理民事赔偿和罚款;四是在应诉中,积极有效地抗辩,并辅以强有力的证据、律师团队和专家证人支持;五是通过公关宣传等手段,做好整体策应和配合。同时某些做法也值得反思,例如为获得有利结果而滥用法律工具,对上诉与否及启动时机的选择不够得当,对项目运行全过程的合规和风控管理仍有改进空间等。BP adopted an array of comparatively effective measures in mitigating and settling claims arising from the Gulf of Mexico oil spill. Those measures consisted primarily of: 1) making every effort to stop and contain losses and damage caused by the accident; 2) prioritizing amicable settlement wherever acceptable; 3) handling criminal prosecution and class action fi rst in case they overlap with civil claims and fi nes; 4) engaging in active defense by making full use of favorable evidence and the skills of professional attorneys and expert witnesses; 5) conducting public relations and related activities within an overall strategy. However, lessons need to be learned from taking abusive legal measures to obtain a favorable result, being insuffi ciently mindful of timing legal in deciding whether or not to appeal, needing improvement in day-to-day compliance and risk-control throughout project operations, etc.
