论银行个人理财纠纷救济机制的构建

摘  要:我国银行个人理财业务蓬勃发展,同时,银行个人理财纠纷也层出不穷,投资者合法权益经常受到损害。我国目前的银行个人理财纠纷救济机制涉及了多种救济方式,基本符合多样化的要求,但是不够合理,存在事前救济乏力、ADR救济不足、诉讼救济不完善、重行政处罚轻民事救济等不足与缺陷。应重视事前救济,加强准入监管,大力发挥ADR制度的作用,不断改进理财纠纷诉讼制度,最终构建合理的理财纠纷救济机制,最大限度地保护理财投资者的合法权益。Personal finance business in banks is blossom in China. Meanwhile, personal financial disputes are e- merging too. Investors' legal rights and interests are often subject to damage. The current personal financial dis- pute and relief mechanism of banks involves a variety of methods, which meet the requirements of diversification. But the mechanism is not reasonable enough. There are some defects and weaknesses, such as relief sluggishness beforehand, lack of ADR relief, imperfect litigation relief, emphasizing administrative penalties and ignoring civ- il relief. Therefore, it is important to attach attention to relief in advance and strengthen the access regulation. It is still crucial to give full play to ADR system. It is also vital to improve financial dispute litigation system and build a reasonable financial dispute and relief mechanism ultimately so as to protect the legitimate rights and in- terests of financial investors at utmost.
