摘  要:提出了一种基于专利引证密度的专利丛探测方法,寻找专利池中的专利引证密度黑洞,验证专利池与专利丛共存的必然性,并以此证明专利池存在的必要性,消除专利池技术垄断的嫌疑。从1394专利池中采集了64个美国专利,从美国国家经济研究局的专利数据集中采集了135条专利引证数据,利用Pajek构建专利引证网络。结果表明:1394专利池中存在一个黑洞,其专利引证高度密集,且明显高于周边;黑洞内部各项专利在权利保护范围上均存在一定的交集,应该是高速传输数字接口领域的一个专利丛。This article proposes a method of patent thicket detection based on patent citation density, looking for a black hole of patent citation density in a patent pool. The aim is to verify the inevitability of the coexistence of a patent thicket and a patent pool, prove the ne- cessity of the existence of a patent pool, and then eliminate the technological monopoly suspicion of a patent pool. This article collects six- ty-four American patents from the 1394 patent pool, and extracts one hundred and thirty-five patent citations from the dataset of the Na- tional Bureau of Economic Research, and then builds a patent citation network with the help of Pajek. The results show that: there is a black hole existing in the 1394 patent pool, whose patent citations are highly populated, and significantly higher than the surrounding; the fights protection ranges of patents within this black hole have intersections. So it should be a patent thicket in the field of high-speed transfer digital interface.
