摘　　要：辨认是侦查实践中适用频率较高的一项常规侦查措施,侦查辨认笔录是法定的证据形式。调查表明,侦查辨认在侦查实践中广泛使用并存在多种不规范情形,这与规范侦查辨认措施的相关法规不完善密切相关。侦查辨认相关立法的不完善在司法实践中产生了非常消极的作用,错误辨认成为刑事错案发生的重要原因之一。为了规范侦查辨认行为,提高辨认笔录证据的可靠性,遏制刑事错案的发生,有必要从诉讼程序与诉讼证据两个方面改革完善侦查辨认制度。Identification is one of the high frequency of the investigation practice and a conventionalinvestigation measure. The investigation of the identification record is a legal evidence form. Investigationshows that there are many kinds of non-normative cases in the investigation practice, which is closelyrelated to the relevant imperfect laws and regulations. Investigation to identifying the relevant legislation isnot perfect, which produces a very negative role in the judicial practice. The error identification hasbecome one of the important reasons for the misjudged criminal cases occurred. To standardize theinvestigation to identify behavior, improve the recognition reliability of the evidence of the transcript, andcurb the occurrence of the misjudged criminal case, it is necessary to reform and improve theinvestigation and identification system from the two aspects of judicial proceedings and evidence inlitigation.Identification; Identification process; Non-normative identification behavior; Reform
