摘　　要：刑法规范包括显性的规范语言表达与隐性的规范保护目的,前者划定刑法文本的文义,而后者则决定着刑法文本之文义射程,两者互为纠缠、相互制约,有助于避免单纯的逻辑推演所形成的合法但不合理之解释结论。规范保护目的不仅是从法秩序之目的确定构成要件行为的范围和违法判断的实质依据,而且是在规范语言表达的基础上对法官之有罪认定进行的"二次过滤",刑法分则中的空白罪状之违法性判断、兜底条款之合类型解释与定量要素之罪责判断,均应该立足于规范保护目的之判断而展开。The norm of criminal law includes dominant specification language expression and recessive specification protection purpose. The former delimit the literary content of criminal law text and the latter decides the range of the literary content of criminal law text. They tangle and interact with each other in order to avoid legal but unreasonable explaining results which is resulted from simple logical deduction by reasoning. Specification protection purpose can not only confirm scope of constitutive requirement and essential evidence of illegal judgment from the purpose of legal order, but also a secondary filter of guilt affirmation of the judge on the basis of specification language expression. Illegality judgment blank facts about a crime, type interpretation of save clause, responsibility for an offence judgment of the quantitative elements in specific provisions of criminal law should all be developed on the basis of judgment specification protection purpose.
