摘 要:在经济全球化、知识经济发展迅猛的时代,美国作为世界知识产权的最大输出国,开始从关注知识产权立法转向知识产权执法。美国不仅将知识产权执法纳入知识产权保护的衡量指标体系,而且在单边、双边和区域等层面不断加大知识产权执法力度,其推出的《跨太平洋伙伴关系协议》(TPP协议),知识产权执法标准都远远超过TRIPS协定所规定的标准。面对美国强力推进超TRIPS知识产权执法的态势,我国应该采取有策略的因应之道,建立自己的知识产权执法衡量指标体系,本着"合作共赢"的态度,充分发挥非政府组织的作用,根据自身实际实施可持续发展战略。With the rapid development of'Knowledge Economy'in the era of economic globalization,the United States is growing to be the world's largest exporter of intellectual property and beginning to turn its attentions from intellectual property legislation to intellectual property enforcement.Enforcement of intellectual property rights is not only incorporated into the evaluation system of intellectual property protection,but also continuously strengthened by the United States in various agreements of unilateral,bilateral and regional levels.This is highlighted especially in the latest'Trans-Pacific Partnership Agreement'(TPP),in which the standards of intellectual property enforcement are far beyond those required by the TRIPS Agreement.Facing the situation of TRIPS-Plus enforcement of intellectual property pushed by the United States,China should establish its own Index System of Intellectual Property Enforcement,cope with new strategies of'cooperative game'attitude,give full play to the role of non-governmental organizations,carry out scientific and rational strategies of intellectual property enforcement.
