摘　　要：领馆车辆享有一定的领事特权与豁免。根据中外领事关系条约的一般条款,领事官员对交通违章行为享有司法和行政管辖豁免,不应受到刑事和行政处罚;但是领馆行政技术人员和服务人员却不能因交通违章行为享有司法和行政管辖豁免,相反却应受到处罚。包括领事官员在内的所有领馆成员都不能享有因交通事故而引起的民事赔偿责任豁免。但外国在华领馆成员享有的领事特权与豁免的具体内容以中国与该国签订的领事关系条约为准。Vehicles of a consular post will enjoy certain privileges and immunities relating to consular. According to the general clauses of Sino--Foreign treaties on consular relations, consular officers shall not be amenable to the jurisdiction of the judicial or administrative authorities of the receiving State for their traffic violations, while consular employees would be subject to. All members of the consular staff including consular officers shall be amenable to the civil action by a third party for damage arising from an accident in the receiving State caused by a vehicle. The specific privileges and immunities of members of the consular staff depend on the Sino--Foreign treaties on consular relations.
