摘　　要：结合20年来国家经济社会和法治建设以及体育改革不断推进的历史发展,认为《中华人民共和国体育法》(以下简称"《体育法》")越来越显现出其为实施宪法、适应体育改革发展和依法治体需要应运而生的历史必然和重大意义,从确立和维护体育发展地位、巩固和推动体育改革、保护体育权利和促进体育普及发展、推动体育法治建设等方面,总结了《体育法》所取得的重要成效和作用,并基于特定的时代背景和社会环境,从实施不佳影响功能发挥和自身存在的不足缺陷两个方面,分析了《体育法》存在的主要制约与问题,进而提出应理性把握完善《体育法》需选择的修法方策,从抓住有利时机,加大修改《体育法》的工作力度、提供修改《体育法》的充分理由和依据、明确修改《体育法》的性质定位和指导原则、确定《体育法》的修改幅度和修改模式、重构《体育法》的立法宗旨和价值取向、提升《体育法》的形式理性和技术质量等方面进行了阐述。Combined with the historical development of 20 years to the country＇s economy, soci ety and the construction of the rule of law and sports reform continuously advancing, this paper concludes that sports law has become more and more important for the implementation of the constitution, to adapt to the development of sports reform and the need for the law governing body. From the aspects of the establishment and maintenance of sports development status, to consolidate and promote the sports reform, the protection of sports rights and promote the de- velopment of sports, promote the construction of sports law and so on, the dissertation sums up that the sports law makes an important effect. Based on specific time background and social en- vironment, from two aspects of the implementation of the poor function and the existence of its own shortcomings, the main constraints and problems in sports law are analyzed, and then put forward the rational grasp of the sports law need to choose the approriate strategy. We need seize the favorable opportunity, increase to modify the efforts of sports law, provide sufficient reason and basis of modification of sports law, clear the nature localization and the guiding principle of sports law to modify, determine the magnitude and modified model of the sports law to modify reconstruct legislative purpose and value orientation of sports law, enhance the formal rationality and technical quality of sports law.
