西北地区重金属污染法律防治的困境与出路

摘　　要：近10年来,中国工业化进程不断加速,随之而来的是重金属污染事件频发,其严重影响了经济社会的可持续发展。西北地区由于拥有丰富的重金属资源、涉及重金属的行业居多,而生态系统脆弱,加之重金属污染防治不利,重金属污染问题日益凸显。于是建立西北地区重金属污染防治体系特别是法律防治体系刻不容缓,但由于缺少长期稳定的综合性法律法规的保障、健全的重金属污染的监管体制、充足的治理、赔偿资金以及广泛的公众参与,西北地区的重金属污染法律防治面临困境。因此,制定重金属污染防治的地方法规、明确各省区重金属污染的防治管理体制、筹集重金属污染的防治及赔偿资金、加强环境教育,保障公众参与成为眼下建立法律防治体系的重要举措。In the past 10 years, Chinese industrialization process was accelerating and caused heavy metal pollution with frequent accidents, which seriously influenced the sustainable development of economic society. Heavy metal pollution problems in the North-west China have become increasingly prominent because of lot of reasons such as rich heavy metal resources and many related heavy metal industries as well as fragile ecological system and poor heavy metal pollution prevention. Therefore, it＇s urgent for North-west China to establish a heavy metal pollution prevention system, especially a law-based prevention system. However, because of lack of the guarantee of long-term and stable comprehensive laws and regulations, perfect supervision system, adequate governance, compensation funds and extensive public participation, legally prevention and control of heavy metal pollution in the northwest region is facing dilemma. Therefore, lots of important measures should be taken to establish a legal prevention and control system at present, such as enacting local laws on heavy metal pollution prevention, establishing every province＇s administration system of the heavy metal pollution prevention, raising the heavy metal pollution prevention and compensation funds, strengthening environmental education and ensuring the public participation and so on.
