摘　　要：植物新品种名称是构成植物新品种权的必要条件之一,也是近年来侵犯品种权的重要环节。由于立法中缺失基于品种名称设立的专门性权利,使得现实中针对品种名称实施的侵权行为非常普遍和猖獗。当前,无论是在学术界,还是在农业生产科研等相关部门,对于植物新品种名称与品种名称的关系,以及品种名称自身所能发挥的重要作用还存在模糊认识,有必要对这些问题进行厘清并进一步加以有效地利用。The denominations of new varieties is one of the essential requirements of the right of new plant varieties, also is an important part of the infringement of the right of new varieties in recent years.Because we lack special rights in the legislation which based on denominations of new plant, it has led to serious consequences for Infringement of breed name. At present, both in academia and in agricultural production, scientific research and other relevant departments, most people could not realize clearly the relationship between variety denomination and name of new varieties, and the breed name＇s important role, it is necessary to clarify these questions and further to effectively use them.
