对跨国婚姻中越南妇女权益的法律保护研究

摘　　要：在中国广西边境地区,存在有大量的基于非法越境、非法居住、非法婚姻而产生的跨国婚姻现象,越南妇女们由于地理、历史、文化和经济原因嫁到中国,但她们在中国却遇到了来自"身份"和"福利"问题的双重困扰。从立法、行政、司法三个维度对跨国婚姻中越南妇女权益存在的问题进行分析,对其给予法律上的保护不仅具有理论必要性还具有实践可操作性,进而针对性地提出若干建议,具体可以实施分阶段、分步骤的"三步走"战略以解决其所面临的"身份"和"福利"难题,并应当同时加强行政执法和司法工作来进一步保障其合法权益。In Guangxi,illegal transnational marriage is a very common phenomenon. Their marriages are based on geographical,historical,cultural and economic reasons. The conflicts of systems and the defects of Law cause these women’s identity and welfare problems. In this paper,through analyzing the existing issues of transnational marriage Vietnamese women face with three dimensions of legislation,administration,justice; putting forward that giving legal protection to them not only has the theoretical possibility also has the practical operability. And then the author advises some strategies,which can be implemented step by step to solve the problems.At last we should also strengthen the enforcement of administrative law and judicial work to further safeguard the legitimate rights and interests.
