摘 要:在交易便捷的时代背景下,不动产一物数卖的现象时常发生。一物数卖的合同效力和物权归属一直倍受争议。针对一物数卖的物权变动问题,需要对数合同的效力首先加以认定,在不违反合同法强制规定的前提下,应认定合同有效;综合我国的物权变动区分原则,对不动产一物数买的物权归属情况分别界定;借鉴国外经验,对不动产一物数卖物权变动制度的缺陷加以弥补,进一步规制相关物权制度,如不动产预登记制度、转交付支付、不动产登记制度等,使不动产物权变动趋向于快捷、合理,以适应市场交易的需求,切实解决好一物数卖的物权纠纷。In the era background of the convenient transaction, the kind oi phenomenon often occurs mat estate thing is sold for times. The validity of the contract and of the real estate sold for times of validity of real fight has been controversial. To deal with the problem of its ownership transfer, it's necessary to confirm the contract's legal effect, without violation of the mandatory provisions of the contract law; the contract shall be deemed valid. Combine our country real fight alternation principle of distinction, according to different situation to identify the ownership of real estate thing sold for times; learn from experience and success stories of foreign countries, compensate for the shortcomings of the real property transfer system, further improve the relevant system of real right, such as advance notice registration system of estate, payment system, the real estate registration system, to make the real property right change tend to be fast and reasonable, to meet the requirement of market transaction, which to solve the disputes exactly over property rights of the thing sold for times.
