涉检信访案件终结机制批判与重构

摘　　要：2014年8月28日,最高人民检察院出台了《人民检察院控告申诉案件终结办法》,对符合涉检信访终结条件的案件依法终结,目的是为了解决信访终结制度缺失所引发的缠访、越级访、重复访等问题。然而通观该办法,规则分散、笼统、互相矛盾的缺陷仍然存在。立足于《人民检察院控告申诉案件终结办法》,在对其中规则条文进行详细阐述的基础上,着重剖析规则条文间存在的问题,通过解决涉检信访终结案件的范围、条件等前提问题,继而提出完善涉检信访终结具体程序运作的可行性建议,以期能够科学衔接涉检信访终结和司法救济,引导群众弃访转法。In August 28, 2014, the Supreme People＇s Procuratorate promulgated Measures of the People＇s Procuratorate for the End of the Appeal Case, which is to end the case when they are in line with the conditions of the termination of the case of the petition according to the law, in order to solve the wrapped visits, leapfrog visits, and repeat visits caused by lack of the system. However, defects still exist in Measures such as rules dispersion, generality and mutual contradictions. Thus, in this paper, based on Measures of the People＇s Procuratorate for the End of the Appeal Case the group emphatically analyzes the existing problems of the rules through detailed elaboration of the rules. Through solving the premise problems of the scope and conditions of the cases the group puts forward the feasible suggestions for improving the operation of the specific procedures of the petition, in order to scientifically link petition end and judicial relief guiding people to abandon visit to the law.
