论科技异化的司法矫治

摘　　要：在当今时代,伴随着科技的加速发展,科技异化也愈演愈烈,科技异化治理成为我们必须直面的重大课题之一。司法矫治是科技异化治理不可或缺的方式和手段,科技异化的司法治理是一项复杂的系统工程,要求实行举证责任倒置、适当采用专家论证、在科技侵权归责中适用无过错责任原则、发展科技公益诉讼。Nowadays, the alienation of science and technology becomes increasingly intense with the accelerated development of science and technology, therefore, its regulation has been one of the major tasks we must face up to. The judicial treatment is an indispensable method and means to the regulation of the alienation of science and technology. Its complex nature calls for the following measures, namely the inversion of the evidential burden, the appropriate application of expert demonstration, the application of the principle of no-fault liability in the identification and investigation of legal liability for the tort resulting from scientific and technological behaviors and the development of public-interest litigation.
