摘　　要：欧盟2012年第650号涉外继承条例条例在适用范围、管辖权分配、继承准据法的确定、判决的承认和可执行性与执行、公文书和法庭和解、欧洲继承证书的颁发及效力等方面作出了明确规定。条例确立了"惯常居所"连结点在管辖权和准据法确定中的基础性地位,在继承准据法的选择上采用"同一制",并创设了具有开拓意义的欧洲继承证书。中国应坚持"经常居所地"连结点的原则性与灵活性的结合运用,采用有例外的"同一制"继承准据法选择方法,增强两岸四地在民商事领域的司法互信,并设立由两岸四地人员组成的专门的常设官方机构,推动我国区际私法的统一化进程。European Union No 650/2012 Regulation on International Succession explicitly stipulates the scope, jurisdiction, applicable law, recognition, enforceability and enforcement of decisions, authentic instruments and court settlements, issue and effects of European certificate of succession. The regulation establishes the foundational？ status of habitual residence in decision of jurisdiction and applicable law, adopts unitary system and creates European certificate of succession. To promote the unification of private interregional law in China, China should insist the habitual residence with the combination of principle and flexibility, adopt uni- tary system with exception, enhance judicial mutual trust in civil and commercial areas with Hong Kong, Macao and Taiwan, and establish special permanent official institutions consisting of experts from four regions.
