摘 要:行政行为说明理由制度是正当程序的基本要求,也是民主法治精神的具体化,承载着制约行政权与保障参与权的双重价值功能。然而,我国说明理由制度出现了规范与实践严重脱节的问题。在对四部法律、一部行政法规和四部地方政府规章共七十四个相关法律条文进行规范分析的基础上以及对中外说明理由制度进行比较分析后发现,我国与西方发达国家的区别主要体现在说明理由的方式、未说明理由的范围及其法律责任三个方面。因此,完善我国说明理由制度,应从确立"书面"说明理由原则、适当扩大未说明理由的范围以及明确行政机关及其工作人员未说明理由的法律责任等方面入手。The administrative action reason-giving system is one of due procedure's basic requirements,and it is the embodiment of the spirit of democracy and legality beating the weight of double value functions in restricting administrative power and guaranteeing participation tight.However,our country's reason-giving system has a problem that norm is disjointed with practice.On the basis of normative analysis of four laws,one administrative regulation and four local government's rules covering seventy-four relevant legal provisions,and after the comparative analysis of reason-giving system between China and foreign countries,it finds that the differences between our country and western developed countries axe mainly embodied in reason-giving ways,not reason-giving scopes,legal liability these three aspects.Therefore,to improve our country's reason-giving system,it should start with establishing "written" reason-giving principles,properly expanding not reason-giving scopes and cleating not reason-giving legal liability of administrative organs and their staff.
