摘　　要：监狱的价值与存在离不开社会认同。社会认同的前提是监狱社会职能的有效实现。在表层物质文化、中层精神文化和深层哲学文化的三个领域，监狱给予社会公众最直观的是以监狱建筑等物质形态景观为代表的表层文化。它以威严、恐惧、不可靠近的特有的社会正义文化信息向社会公众传达社会治理秩序的规则、标准和执行的强制性。监狱建设必须充分考量社会公众的一般认知，以鲜明的监狱物质表层文化发挥监狱的社会职能作用。当下监狱建设应当以现代监狱文化建设的价值内涵为基础，以现代法治要求为根本，认真分析监狱表层文化对于社会治理秩序的影响作用，准确定位现阶段监狱建设的阶段性指导标准，准确表达监狱文化的内涵，更好地实现现代中国监狱建设的社会职能作用。The existence and value of prison cannot be separated from affirmative social recognition, whose premise is the effective realization of the social functions of the prison. In the three layers of the surface material culture, the intermediate spiritual culture and the deep philosophical culture, the surface material culture of prison presents to the public its most direct image, represented by the material form of the prison architecture. With its unique cultural signals of social justice such as authority, awe and distance, prison architecture represents the compulsory rules and criteria of order and law enforcement in social administration. Prison construction must take full account of the general perception of the public, in order to play its social role well with its distinctive surface material culture. Based on the cultural value construction of modern prison and the requirement of law-ruling modern society, contemporary prison construction should analyze carefully the influence of surface culture on social administrative order, specify precisely the guiding standards in current prison construction, and ascertain accurately the main content of prison culture, in order to better fulfill the social functions of modern Chinese prisons.
