摘　　要：艾伦·德肖维茨的权利来源理论认为权利起源于对以往恶行的共识，以及避免此类恶行再次出现。其前提是对于恶行有着普遍性的共识存在。弗朗西斯·福山认为人类在发展的问题上存在共识，然而塞缪尔·亨廷顿从文明的冲突层面对此予以反驳。基于此，可见共识并非普遍存在。Dershowitz Alan＇s theory of Origin of Right think that right is origin of the consensus of the past, as well as to avoid the emergence of such evil again. The premise is that there is a common under- standing of the evil deeds.Francis Fukuyama argues that the human beings in the development of consensus exists.However,Samuel Huntington from the clash of civilizations layer facing the refuted.Based on this, consensus is not widespread.
