摘　　要：从落实宽严相济刑事政策出发,以被告人的人身危险性在量刑中的考量为视角探讨量刑自由裁量权的实体性规制和程序性规制,试图为如何规制量刑自由裁量权提出具体的建设性意见。实体性的规制主要是提出将被告人的人身危险性纳入量刑根据以对量刑时是否考量被告人的人身危险性予以规制、在量刑原则中引入比例原则以对考量被告人的人身危险性的度予以规制、细化有关人身危险性的量刑情节以对考量被告人的人身危险性偏颇予以规制。From the implementation of the criminal policy of combining punishment with leniency starting with the defendant＇s dan- gerousness in sentencing considerations in sentencing freedom to explore the perspective of substantive and procedural regulations regu- latory discretion, this paper tries to make some concrete and constructive for how to regulate Discretion opinion. Substantive regulation is proposed mainly included the defendant＇s dangerousness sentencing sentencing according to whether or not to consider the defendant dangerousness to be regulated, the introduction of the principle of proportionality in sentencing principles in order to consider the de- fendant＇s degree of dangerousness be regulated, refine relevant dangerousness of sentencing to consider the defendant＇s dangerousness for biased to be regulated. Procedural regulation mainly consider establishing procedures and strengthen sentencing sentencing consensual debate program, consider the views of the victim＇s sentencing, the importance of the local people＇s sentencing investigation to demon- strate the defendant＇s dangerousness to regulate the judge to consider the defendant dangerousness randomness. Only Discretion reasona- ble regulation, under the criminal policy guidance to temper justice with mercy, and the case thrown discretion ＂black box＂ where after pulling out a lawful and humane ends of justice.
