摘 要:研究目的:探究资本下乡背景下的集体土地产权演化、冲突磨合机制,为解决农地流转冲突提供新视角。研究方法:F-H模型分析法、案例分析法和归纳总结法。研究结果:(1)集体土地产权演化分为产权均衡稳定期、产权冲突磨合期和新产权结构形成期,流转权作为土地剩余产权,在外部作用力和产权主体自适应行为的共同作用下处于动态界定中;(2)农地流转冲突的本质是土地产权演化冲突,村社组织、农户和工商企业在F-H冲突分析模型中的全局稳定局势的策略选择集合是{掠权流转,有条件流转,与村社组织合作};(3)大规模农地流转中,工商企业与村社组织之间的结盟为象征地权的膨胀和强化创造了有利条件,村社组织攫取了以流转权为代表的土地剩余产权。研究结论:(1)农地流转冲突的实质是契约地权和象征地权对土地剩余产权竞相控制和拥有的产权演化冲突;(2)处理好契约地权与象征地权的关系,明晰两种权利在土地剩余产权中的占有权能,尽快界定土地剩余产权,有助于解决农地流转冲突。The purpose of this paper is to analyze the evolution, conflict and running mechanism of the collective land property under the background of capital inflow in village in order to offer a new perspective to solve the conflict of farmland transfer. Methods employed include F-H model analysis and case analysis. The results show that evolution of collective land property is divided into equilibrium stability, conflict period and formative period of the new property structure, transfer right as surplus land property which is in the dynamic definition effected by adaptive behavior of property subject and external forces. Under farmland transfer conflicts is the evolution of land property, the global stability in F-H model of rural organizations, farmers and businesses is {grazing rights transfer, conditional transfer, working with rural organizations}. The alignment between businesses and rural organizations in large-scale tarmtand transter creates advantageous conditions for the expansion and strengthen of symbol land right, rural organizations capture transfer right. The paper concludes that that it is property evolution under the farmland transfer conflict, which is contractual and symbolic land rights control and ownership the surplus land property. It is important to define land surplus property and its premise condition is dealing with the relation between contractual and symbolic land rights.
