摘 要:环境权是伴随着人类环境危机而产生的一种新型权利。环境保护公众参与的法律机制对于维护环境权、保障公众有效参与环境保护具有重要意义。但我国现行环保公众参与的法律机制在信息公开、参与公共决策以及参与救济机制等方面存在严重不足。完善我国环保公众参与的法律机制,应提升信息公开有关法律的权威性和可操作性,对公共决策公众参与制度予以实体与程序性保障,建立适合于各类监督参与主体的监督方式,完善环保行政复议、行政诉讼和公益诉讼三大救济制度。Environmental right is a new kind of right, which is accompanied with the crisis of human environment. The legal mechanism of public participating environmental protection plays an important role in the maintenance of public environmental rights and the realization of public effieiently participating environmental protection, but the current legal mechanism of publie participating environmental protection in China is relatively weak in environmental information disclosure, public participating decision - making mechanism, public participating supervision, and environmental rights relief mechanism. To realize legal mechanism of public participating environmental protection, we should enhance the authority and operability of information disclosure, endow substantive and procedural safeguards to public participation system of the public decision - making at all levels, establish the supervision mode for all kinds of participating subjects, perfect environmental administrative reconsideration, administrative litigation and public interest litigation relief system.
