征收视野下的美国社会责任财产权观及对我国的启示

摘　　要：社会责任财产权观作为共和主义思想的精髓,在自然权利财产权观盛行的美洲大陆经历了一个复杂的、艰辛的发展历程。学者和法院对社会责任财产权观的青睐一直饱受争议,但法院对一系列征收案件的裁决结果表明,法院对社会责任财产权观进了坚守,力争实现私人财产权与政府权力的衡平,并取得了举世瞩目的成就,这对我国因拆迁所引发的征收难题的消解具有启示作用。我国应当借鉴美国经验,树立社会责任财产权观,奉行最小损害原则,建立协议价购——独立裁决——征收目的检验体系,力争实现私人财产权与政府权力的衡平。The property right concept of social responsibility, as the quintessence of republi- canism, has gone through a complex and difficult development process while the property right concept of natural right is popular in the American continent. Academics and courtsJpreferring to the property right concept of social responsibility has been controversial, but the verdicts the Court made on a series of cases show that the Court insists on the property right concept of social responsibility, tries to achieve the balance between the private property rights and the governmen- tal power and acquires remarkable achievements, which is possessed of the revelatory function to deal with our country ~s takings problems caused by demolition. China should draw experience from the United States,we should set up the property right concept of social responsibility, persue the minimum damage principle, establish the system of negotiated acquisition -independent adju- dication -checking the goal of takings and attempt to achieve the balance between the private property rights and the governmental power.
