摘  要:本文试图将我国党政机关、法院、公安、仲裁和律师横向比较,把其功能重新配置,产生正面互动,以推动法律服务的全面改革,从一个侧面破解政治改革难题。文中首次提出在我国设立“法律服务特区”的建议,在特区里向外国律师开放商事法律业务,并建议从立法层面确立我国仲裁机构的民间独立地位,把仲裁服务全面推向市场。本文设定法律服务改革的目标,旨在建立“廉洁高效小政府,公平竞争大市场”。Through comparison among party and government organizations, courts, police, arbitration and lawyers this article tries to relocate the organizations into their best places in order to improve the implementation of legal service reform in China, with the future intention of making a break-through of the first time in the country, suggests political reform. The article, for the to set up the "Special Legal Service Zone". As the first step China should open its commercial legal service to foreign lawyers. The article also suggests the highest legislation should confirm arbitration's non-governmental status, by law, to free arbitration from government control. The final goal of the legal service reform will be to establish an incorruptible and high-efficiency small government surrounded by huge and fair competitive market.
