摘 要:《标准施工招标文件》(2007年版)、《建设工程施工合同(示范文本)》(GF-2013—0201)均规定,承包人应在知道或应当知道索赔事件发生后28天内,向监理人递交索赔意向通知书,否则丧失要求追加付款和(或)延长工期的权利。上述28天即为索赔期间。关于索赔期间经过后当事人是否还享有索赔的权利,实践中存在不同观点。本文通过分析索赔期间的法律性质给出了结论。最后,对索赔期间在我国建设工程领域的适用提出了建议。According to Standard Construction Bidding Documents (2007 Version) and Construction Contract (Model.Form) ( GF -2013 - 0201 ), it specifies that the contractor shall give notice of his intention to claim to the supervisor within 28 days after becoming aware, or should have become aware of the claim event, otherwise the contractor shalllose his rights to extend the time for completion and additional payment. The 28 - day period mentioned above is called claim period. If the contractor fails to give notice of the claim within such a period, does he really lose the rights to claim? There are different points in practice. In this paper, a conclusion is presented by analyzing the legal nature of claim period. At last, some advice is proposed about the application of claim neriod in construction field in China.
