摘 要:中国企业传统上不乐意接受将国际仲裁作为争议解决方式,而更倾向于将争议诉诸中国仲裁机构或法院,主要是基于国际仲裁费用高昂的考虑。国际仲裁有时甚至被认为是只有大型跨国公司才承受得起的"奢侈品"。但是,国际仲裁费用高昂并非"命该如此",对费用成本的控制很大程度上还是取决于涉案当事人对仲裁程序的设计,以使仲裁成为高效、经济并有助于企业的争议解决方式。国际仲裁的费用主要有三大部分组成:律师费用、专家费用以及仲裁员的费用。本文通过描述国际仲裁的费用构成,分析影响仲裁费用水平的因素,提出一系列能够有效控制成本的切实建议。Chinese businesses have traditionally been reluctant towards international arbitration in particular because of the costs. International arbitration is sometimes considered a luxury that only big multinational companies can afford. However, high cost of international arbitration is not a fatality. It largely lies in the hands of the parties to control these costs and design their arbitration proceeding in a cost- efficient and business-friendly way. The costs of international arbitration are mainly determined by three types of costs : the lawyer ( s)' fees and expenses, the expert ( s)' fees and expenses and the arbitrator (s)' fees and expenses. This article describes these various types of costs, what determines their level and provides the reader with practical recommendations on how to efficiently curtail the costs.
