摘 要:新《环境保护法》的实施标志着公众环境知情权在我国的正式确立。新《环境保护法》不仅拓宽了政府这一关键义务主体的范围,有限度地确立了企业的义务主体地位,规定了"环评项目"的信息公开制度,而且初步构建了公众环境知情权救济机制,实属"迈进了一大步",但现有规定远未至完善,仍存在不少问题,不仅对政府环境信息公开义务规定尚存不足、对企业环境信息公开义务规定仍存缺陷、对公众环境知情权救济机制规定未尽完善,而且未对环境信息公开的范围作妥适界定。为保障权利的有效行使和制度目标的顺利实现,当前亟需完善公众环境知情权实现机制。具体来说,不仅应赋予公众以主动申请获得环境信息的权利、明确环境信息公开"重点排污单位"的界定主体及规则、合理界定环境信息的公开范围,并建立健全公众环境知情权的司法救济制度。The implementation of the new Environmental Protection Law marks the formal establishment of the public environmental right to know in our country. It broadens the scope of the government as the key subject of obligation, establishes limitedly the position of enterprise as the subject of obligation, regulations the system of environmental impact assessment project's information disclosure, and preliminarily constructs the remedy mechanism of the public environmental right to know. It takes a big step forward, but not perfect, and there are still a lot of problems. It is still inadequate on the obligations of government' s environmental information disclosure, is still defective on the disclosure of enterprise "s environmental information disclosure, is not perfect on the relief mechanism of the public environmental right to know, and the scope of environmental information disclosure is not appropriate definition. At present, it is urgent to improve the realization mechanism of public environmental right to know in order to ensure the effective exercise of the rights and the successful implementation of the system objectives. The right should be given to the public to take the initiative to apply for access to environmental information, who and how to define the Key Sewage Units should be clear, the disclosure scope of environmental information should be reasonably defined, and the judicial remedy system of public environmental right to know should be perfect.
