云南边境跨国婚姻问题与和谐边疆构建的对策研究

摘　　要：由于地理、文化、经济、政治、法律等因素在云南边境地区存在大量非法的跨国婚姻，这些嫁入中国的外籍妇女成为我国“事实上的公民”，但在法律为“三非人员”，其“身份”与“权益”得不到认可和保障，引发了一系列影响边境稳定的社会问题。云南边境跨国婚姻具有缓解国内婚姻市场矛盾的作用，抓好具有独特性状的边民跨国婚姻管理，对维护社会稳定、构建和谐边疆具有极其重要的意义。本文通过实地调研与越南、老挝、缅甸接壤的三个典型边境村寨，分析云南边境跨国婚姻的特点和存在的问题，并对解决边民跨境通婚问题与构建和谐边疆提出对策建议。Due to the geographical, cultural, economic, political and legal factors, there are a lot of illegal cross- border marriages in the border area of Yunnan Province. Those foreign women, illegally married to Chinese, become ＂de facto citizens＂ in China but as ＂three non-staff＂, their ＂identity＂ and ＂equity＂ are not recognized and guaranteed. This triggered a series of problems which affected the social stability in the border area. The cross-border marriage is one way to relieve the domestic contradictory in marriage situations, so a good management of this special cross-border marriage among border citizens is extremely important to maintain the stability and build harmony in border area. This paper researches the cross-border marriages in three typical villages bordering Vietnam, Laos and Myanmar, analyzes their characteristics and problems, and proposes corresponding for the cross-border marriage and harmony in the border area.
