摘 要:在专利侵权案件审判中,如何找到专利争议与技术审判的利益平衡点是当前困扰专利诉讼的重要难题之一。专利法适用中的技术判定难题、专利审判的专业化以及有专业法庭(院)不等于有专业法官等现实因素,导致了如何科学解决技术与专业审理之矛盾变得难上加难。文章通过全面考察美国、德国以及我国台湾等对技术问题处理方式,深入阐述了技术与专业化审判之间的博弈,以及对技术审查官(技术法官)来源的全方位反思,为我国未来探索建立一体化技术调查认定体系提供合理的应对路径。How to find balance of interests in patent disputes and technical trial is one of the important plaguing of patent litigation during judgement of patent infringement cases. The Terms & Conditions in patent law such as Technical determination problem, specialization of patent trail and lack of professional judges in professional court leads to difficulty in judgment problems solving scientifically between technology and specialization. The tenor of article is providing a reasonable response path for building and exploring of integration technology surveying & Identification system for our country in future by describing the gaming on trial of technology and specialization, and comprehensive reflection of technical Judges Source through comprehensive study on technical issues settlement of the United States, Germany and China's Taiwan.
