街头官僚行政自由裁量权:权变、困境及其规制

摘　　要：街头官僚是政府的一线工作人员,其行政自由裁量权的存在具有客观性和必要性。街头官僚的行政行为是一个权变函数,其权变因素包括街头官僚特征、行政相对人特征和街头环境。街头官僚行政自由裁量权的两面性、伦理困境以及效率与公平权衡困境。由于存在权变因素和困境,使得街头官僚在行使行政自由裁量权过程中会出现各种偏差。因此,应结合街头官僚及其行政自由裁量权的特征,从完善法律、制定"街头版"权力清单、完善权责对等的责任机制、提高街头官僚的行政素质等方面予以规制,使街头官僚行政自由裁量权发挥良性作用。Street-level bureaucrats are the governments’ front-line staff members whose existence of the administration discretion has objectivity and necessity.The administrative action of street-level bureaucrats is a contingency function whose contingency factors include characteristics of street-level bureaucrats,characteristics of administrative relative persons and the street environment,the dual character of the street-level bureaucrats’ administration discretion,ethical dilemmas as well as efficiency and justice balance dilemmas.Because there exist contingency factors and dilemmas,various kinds of deviations appear in the process of street-level bureaucrats performing the administration discretion.Therefore,it should combine characteristics of street-level bureaucrats and the administration discretion,and regulate from aspects of improving laws,formulating ＂street-level＂ power lists, improving the liability mechanism of rights and liability equivalence and enhancing the comprehensive quality of street-level bureaucrats to make the street-level bureaucrats’ administration discretion play a good part.
